Terms of Service Effective: June 16, 2026
These Terms of Service ("Terms") govern your use of APIFlux's AI API gateway service. By using our service, you agree to these terms.
In short: APIFlux provides an AI API gateway that routes requests to upstream model providers at passthrough pricing. These terms define what you can and cannot do with our service, how billing works, and our liability limits.
1. Acceptance of Terms
By accessing or using APIFlux (the "Service"), operated by APIFlux ("we", "us", or "our"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
2. Description of Service
APIFlux provides:
- AI API Gateway: A unified OpenAI-compatible endpoint (
https://api.apiflux.cc/v1) that routes your AI model inference requests to multiple upstream providers.
- Passthrough Pricing: We pass through the pricing from upstream providers without markup — you pay exactly what the upstream provider charges, plus any applicable payment processing fees.
- BYOK Mode: Option to use your own API keys with supported providers for direct routing.
- Model Aggregation: Access to models from OpenAI, Anthropic, Google, Meta, Mistral, and other providers through a single API key and consistent interface format.
3. Account Registration & Security
- You must provide a valid email address to create an account.
- You are responsible for maintaining the confidentiality of your account credentials and API keys.
- You must notify us immediately if you suspect unauthorized access to your account.
- You are responsible for all activity that occurs under your account.
- You must be at least 16 years old to use the Service, or the age of majority in your jurisdiction if higher.
Important: Treat your API keys like passwords. Never share them in public repositories, client-side code, or untrusted environments.
4. Acceptable Use Policy
You agree NOT to use the Service to:
Prohibited Uses
- Violate laws or regulations: Engage in any activity that violates applicable local, national, or international law.
- Harmful content: Generate content that promotes violence, terrorism, self-harm, child exploitation, hate speech, harassment, or discrimination.
- Misinformation / Deception: Create deepfakes without disclosure, generate misleading political content at scale, or impersonate individuals/entities fraudulently.
- Malware & Security: Generate malicious software, exploit vulnerabilities, conduct DDoS attacks, or attempt to reverse-engineer or probe our infrastructure.
- Spam & Abuse: Send unsolicited bulk messages, engage in credential stuffing, rate limit abuse, or create automated accounts in bad faith.
- Intellectual Property Infringement: Generate copyrighted material without authorization, reproduce proprietary data, or circumvent access controls.
- Bypass Controls: Attempt to bypass safety filters, rate limits, authentication mechanisms, or usage quotas.
- Competitive Use: Resell or redistribute our service as a competing API gateway or proxy without prior written consent.
AI Model-Specific Restrictions
- Each upstream provider has its own acceptable use policy that applies when you access their models through our service. You are responsible for compliance with each provider's terms.
- We reserve the right to block requests that violate provider policies, even if they are not explicitly listed above.
5. Pricing & Billing
5.1 Passthrough Pricing Model
APIFlux operates on a passthrough pricing basis:

5.2 Billing Cycle & Payment
- Usage is billed on a pay-as-you-go basis based on actual token consumption.
- You must maintain sufficient balance/credits to cover your usage. Requests may be rejected if your account is depleted.
- All fees are quoted and charged in USD unless otherwise specified.
- Taxes (VAT, GST, sales tax) may be added where required by law based on your jurisdiction.
5.3 Refunds & Disputes
- Due to the real-time nature of AI inference services, charges are non-refundable once a request is successfully processed and delivered.
- If we experience a service outage affecting your requests, we will credit affected usage back to your account upon request.
- For billing disputes, contact us within 30 days of the charge date.
6. BYOK (Bring Your Own Key)
When using BYOK mode:
- You provide your own API key(s) for one or more upstream providers.
- Your requests are routed directly to those providers using your credentials.
- You are billed directly by the upstream provider for usage under your own account with them.
- APIFlux may charge a separate fee for BYOK routing functionality, disclosed upfront.
- You remain solely responsible for all costs incurred via your upstream provider accounts when using BYOK.
- APIFlux is not liable for any issues arising from your use of BYOK, including but not limited to unauthorized charges from your upstream provider.
7. Uptime & Availability
- We strive to maintain high availability but do not guarantee 100% uptime.
- The Service depends on upstream providers' availability, which is outside our direct control.
- We are not liable for outages caused by third-party providers, network failures, force majeure events, or scheduled maintenance.

8. Intellectual Property
- Our IP: The APIFlux platform, website, documentation, and underlying technology remain our exclusive property.
- Your Content: You retain ownership of your prompts and the outputs generated in response to your requests. We do not claim any rights over your input or output data.
- Licenses: Upstream providers may have specific licensing terms for model-generated content. Review each provider's terms as applicable.
9. Rate Limits & Fair Use
To ensure fair access for all users:
- Rate limits apply per API key. Current limits are published in our API documentation.
- We may adjust rate limits based on account tier, usage patterns, or system capacity.
- Excessive usage that negatively impacts the service for others may result in temporary throttling or account suspension after warning.
10. Termination
- By you: You may stop using the Service at any time. Unused prepaid credits (if any) may be subject to a refund policy available upon request.
- By us: We may suspend or terminate your access if you violate these Terms, engage in prohibited activities, or cause harm to our systems or other users. We aim to provide notice except in cases requiring immediate action (security threats, legal requirements).
- Effect of termination: Upon termination, your right to use the Service ceases immediately. Sections that should survive termination (Indemnification, Liability Limitation, Governing Law) continue to apply.
11. Disclaimer & Limitation of Liability
This section contains important limitations on our legal responsibility. Please read carefully.
- "AS IS" / No Warranty: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory. We do not warrant that the Service will be uninterrupted, error-free, secure, or meet your specific requirements.
- AI Outputs: We do not guarantee the accuracy, reliability, or appropriateness of content generated by AI models accessed through our service. You are solely responsible for reviewing and verifying all AI-generated output before use.
- Liability Cap: To the maximum extent permitted by law, our total aggregate liability arising out of or related to the Service shall not exceed the amount you paid to us in the 3 months preceding the event giving rise to the claim. This applies regardless of the legal theory (contract, tort, negligence, etc.).
- No Consequential Damages: We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, data, or business opportunities.
12. Indemnification
You agree to indemnify and hold harmless APIFlux and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service in violation of these Terms.
- Content you generate using the Service.
- Your breach of any applicable law or regulation.
- Your violation of any third-party rights.
13. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the People's Republic of China, without regard to conflict of law principles.
- Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties.
- If negotiation fails within 30 days, disputes shall be submitted to the competent courts having jurisdiction over our place of business.
14. Modifications to Terms
- We may modify these Terms at any time by posting updated versions on this page.
- Material changes will be communicated via email to registered users at least 30 days before taking effect.
- Your continued use after the effective date constitutes acceptance of the modified Terms.
- If you do not agree with modified Terms, your sole remedy is to discontinue using the Service.
